Terms of Service

By accessing or using Kinmetry ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and Kinmetry. We may update these Terms from time to time; material changes will be communicated in accordance with Section 13.

Kinmetry is a personal health record management application that allows you to:

• Upload and store lab reports, blood tests, and health checkup documents.
• Use AI to automatically extract and organise health metrics from uploaded reports.
• Track biomarker trends over time and across multiple reports.
• Record and manage medication schedules.
• Interact with an AI Health Assistant to understand your health data.
• Generate structured health summaries to share with a physician.
• Manage health records for family members.

• You must be at least 16 years old to create an account. If you are creating an account on behalf of a minor, you represent that you have the authority to do so and accept these Terms on their behalf.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You must provide accurate and complete information when registering and keep your account information up to date.
• You must promptly notify us if you suspect any unauthorised use of your account.
• You may not share your account with others or create multiple accounts to circumvent usage limits.

You agree not to use Kinmetry to:

• Upload content that you do not have the right to share, or that infringes any third party's intellectual property or privacy rights.
• Impersonate any person or entity, or provide false information.
• Attempt to gain unauthorised access to other users' accounts or our systems.
• Reverse engineer, decompile, or extract the source code of Kinmetry.
• Use automated scripts to scrape, index, or harvest data from the Service.
• Introduce malware, viruses, or any malicious code.
• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.

Kinmetry integrates third-party services (OCR providers, AI providers, cloud storage) to deliver its functionality. These services are governed by their own terms and privacy policies. We are not responsible for the practices of third-party providers, but we select and contractually bind them in accordance with our Privacy Policy.

The Kinmetry application, including its design, code, branding, and non-user-generated content, is owned by Kinmetry and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right to use the Kinmetry name, logo, or trademarks without our prior written consent.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

• We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
• AI-extracted metrics and generated summaries may contain inaccuracies. We make no warranty regarding the accuracy, completeness, or reliability of any AI-generated content.
• Availability of third-party integrations (OCR, AI) may vary and is outside our direct control.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KINMETRY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Health decisions made in reliance on AI-generated content or metric flags.
• Errors or omissions in AI extraction of lab report data.
• Loss of data due to accidental deletion or technical failure.
• Interruption or discontinuation of the Service.

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability will be limited to the greatest extent permitted by law. In any case, our aggregate liability to you will not exceed the amount you have paid to us in the 12 months preceding the claim.

You may terminate your account at any time by deleting it from Settings. We may suspend or terminate your access to the Service if we believe you have materially violated these Terms, after providing reasonable notice where practicable. Upon termination, your right to use the Service ceases immediately. Sections 3, 9, 10, and 12 survive termination.

These Terms are governed by and construed in accordance with applicable law, without regard to conflict-of-law provisions. Any disputes arising from or relating to these Terms or the Service will first be subject to good-faith negotiation. If unresolved, disputes will be submitted to the courts of competent jurisdiction.

If you are a consumer in the European Union, you may also have the right to use the EU Online Dispute Resolution platform.

We may modify these Terms at any time. For material changes, we will provide at least 14 days' notice via a prominent in-app notification before the new Terms take effect. If you do not agree to the revised Terms, you should stop using the Service and delete your account before the effective date.
